Boundary disputes
It is not uncommon for neighbours, particularly in residential areas, to disagree and on the position of a boundary whether this is in a new development or whether it is in respect to older properties where hedging or existing fences have been removed.
An experienced Boundary Dispute Surveyor should be engaged to either advise and mediate between two parties, act as a jointly appointed Expert or advise one side.
Boundary Surveyors will carry out detailed investigations into the history of the relevant properties obtain such evidence as is necessary including researching historical records, before submitting an Expert Opinion. Boundary Surveyors are not restricted by practising in any particular area and travel considerable distances in order to advise a Client.
Party Walls
The Party Wall Etc Act 1996 set out strict parameters where Notice has to be given by one owner to his neighbour in respect to work he proposes to carry out.
Not only does this cover the excavation of foundations for a conservatory, extensions or new property, but also such small items as removal of chimneys, cutting into party walls to insert steelwork and loft conversions.
Whether you are a Building Owner wishing to carry out work or an Adjoining Owner who enjoys rights under the Act it is important to take advice early, even when plans are being prepared. Failure to do so could lead to expensive consequences.
